Terms of Service

1. Introduction and Acceptance

Welcome to CoParent. These Terms of Service ("Terms") govern your use of the CoParent mobile application and website (collectively, the "Service") operated by CoParent ("we", "our", "us").

By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

You must be at least 18 years old to use this Service. By using the Service, you represent that you are at least 18 years of age.

2. Description of Service

CoParent is a co-parenting coordination platform that helps separated and divorced parents manage their co-parenting responsibilities. The Service includes:

  • Shared custody calendar management
  • Expense tracking and splitting
  • Secure messaging between co-parents
  • Children's information storage
  • AI-assisted communication tools

3. User Accounts

3.1 Account Creation

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Security

You must immediately notify us of any unauthorised use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.

3.3 Account Termination

You may terminate your account at any time through the app settings. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

4.1 Subscription Plans

CoParent offers both free and paid subscription tiers. Paid subscriptions provide access to additional features as described on our pricing page.

4.2 Payment Terms

Paid subscriptions are billed in advance on a monthly or annual basis. All payments are processed securely through Stripe. By subscribing, you authorise us to charge your payment method for the subscription fees.

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You can cancel your subscription at any time through the app settings or by contacting support.

4.4 Refunds

We do not provide refunds for partial subscription periods. If you cancel your subscription, you will continue to have access to paid features until the end of your current billing period.

4.5 Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated to you at least 30 days before taking effect. Continued use after a price change constitutes acceptance of the new price.

5. Acceptable Use

5.1 Permitted Use

You may use the Service only for lawful purposes related to co-parenting coordination. You agree to use the Service in good faith and in accordance with these Terms.

5.2 Prohibited Conduct

You agree not to:

  • Use the Service to harass, abuse, threaten, or intimidate your co-parent or any other person
  • Upload false, misleading, or defamatory content
  • Attempt to access another user's account without authorisation
  • Use the Service to violate any applicable laws or regulations
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems to access the Service without permission
  • Share your account credentials with others

6. User Content

6.1 Your Content

You retain ownership of any content you upload to the Service, including messages, documents, photos, and other materials ("User Content"). By uploading User Content, you grant us a limited licence to store, process, and display that content as necessary to provide the Service.

6.2 Content Responsibility

You are solely responsible for your User Content. You represent that you have all necessary rights to upload and share such content and that it does not violate any third party's rights or any applicable laws.

6.3 Message Permanence

Important: Messages sent through the Service cannot be edited or deleted after sending. This is a deliberate feature designed to maintain accurate records for potential use in legal proceedings. Please consider your messages carefully before sending.

7. Intellectual Property

The Service, including its design, features, and content (excluding User Content), is owned by CoParent and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

8. Disclaimers

8.1 No Legal Advice

The Service is a communication and coordination tool. It does not provide legal advice. Nothing in the Service should be construed as legal advice or a substitute for consultation with a qualified family law solicitor.

8.2 No Guarantee of Court Admissibility

While we design our Service to create reliable records, we cannot guarantee that any records, exports, or documentation generated by the Service will be admissible in court. Admissibility is determined by the court in each individual case.

8.3 Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

8.4 AI Features

Our AI communication assistant is provided as a helpful tool but may not always produce perfect results. You are responsible for reviewing and approving any AI-suggested content before sending.

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim
  • We are not liable for actions taken by your co-parent or any other user

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless CoParent, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11.2 Informal Resolution

Before initiating any legal proceedings, you agree to contact us at [email protected] to attempt to resolve the dispute informally. We will make reasonable efforts to resolve any issues within 30 days.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CoParent regarding the Service.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

13.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
